
Who knew that two centuries after Benjamin Franklin left this world that a pair of schools bearing his name would peacefully settle their naming dispute?
Ah, to use Franklin in your name! Benjamin Franklin, the American inventor, scientist and one of the founders of the republic, is perhaps one of the most important names anyone would want to be associated with. Businesses, towns, clubs and schools are named for “dear Ben” who died in 1790 at the age of 84.
Two Franklin Schools Collide
At least two institutions of higher learning share the Franklin name including Franklin University of Ohio and Franklin College in Indiana. Both of these institutions have been in operation for more than one hundred years, but recently they’ve crossed paths in a way not previously foreseen.
When Franklin University announced that they would open an Indianapolis campus, Franklin College objected. The Indiana school quickly filed a lawsuit given that that the Ohio school was advertising in the college’s territory, causing confusion to some. In their suit Franklin College said that it appeared to some that the school had changed its name to Franklin University, thereby leading some people to assume that the schools were one in the same. The college asserted that trademark s were violated in addition to claims of unfair competition.
Franklin College Sues Franklin University
This past May, Franklin University signed a lease to occupy a building in Indianapolis with every intent at starting classes beginning in the fall. The school immediately began to advertise is program which is geared toward serving older students. Franklin College, on the other hand, is aimed toward traditional college track students.
Though the lawsuit was filed in early July it has already been settled. Neither side has admitted wrongdoing with no financial award component included. What has been learned is that Franklin University will market itself as “Franklin University of Ohio” or “Franklin University, Columbus, Ohio” beginning on August 3rd in its hand outs and other advertising collateral.
Franklin University Press Release
Following the lawsuit’s amicable conclusion, Franklin University president David Decker issued a press release commending Franklin College while underscoring that the two schools are geared toward reaching different students. Decker noted that Franklin College of Indiana is a liberal arts school whose average student is 23 while Franklin University serves nontraditional students (age 33) who are pursuing professional studies.
